Terms of Service — Telemetry.host

Please read these Terms of Service ("Terms") carefully before using Telemetry.host (the "Service") operated by Telemetry.host ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.

1. Use of the Service

1.1 Eligibility

You must be at least 16 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

1.2 Account Registration

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

1.3 Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
Transmit any data that infringes upon the intellectual property rights of others.
Attempt to gain unauthorized access to any part of the Service or its related systems.
Introduce viruses, malware, or any other harmful code.
Abuse or overload the Service infrastructure, including via automated requests beyond reasonable use.
Resell or sublicense the Service without our prior written consent.

2. Service Plans & Payment

2.1 Free Tier

The Service offers a free tier that includes up to 5 monitors. Free tier accounts are subject to fair-use limits and may have reduced feature availability compared to paid plans.

2.2 Paid Plans

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as described in Section 2.4. We reserve the right to change pricing with at least 30 days' notice to existing subscribers.

2.3 Taxes

You are responsible for any applicable taxes, levies, or duties imposed by taxing authorities. We will collect applicable taxes where required by law.

2.4 Refunds

If you are not satisfied with the Service, you may request a full refund within 14 days of your initial payment for any paid plan. After 14 days, fees are non-refundable.

3. Data & Privacy

3.1 Your Data

You retain ownership of all data you submit to the Service ("Your Data"). By submitting data, you grant us a limited, non-exclusive, royalty-free license to process Your Data solely for the purpose of providing the Service.

3.2 Data Processing

We process data submitted to monitor endpoints (check-in payloads, log content, status codes) in order to detect failures and trigger notifications. Where you enable AI log analysis, your log data may be processed by third-party AI providers subject to their terms and privacy policies.

3.3 Privacy Policy

Our Privacy Policy describes how we collect, use, and protect personal information. By using the Service, you agree to our Privacy Policy.

4. Availability & SLA

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted or error-free operation. Scheduled maintenance will be announced in advance where reasonably practicable. We are not liable for damages resulting from downtime or service interruptions.

5. Intellectual Property

The Service, including all software, algorithms, UI designs, and documentation, is the exclusive property of Telemetry.host and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service solely as described in these Terms. You may not copy, modify, create derivative works, reverse-engineer, or disassemble any part of the Service.

6. Confidentiality

Each party agrees to keep confidential any non-public information disclosed by the other party that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and circumstances of disclosure.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will detect every failure, that notifications will be delivered without delay, or that results will be accurate or complete.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TELEMETRY.HOST BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE FEES PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) USD $50.

9. Termination

9.1 By You

You may terminate your account at any time via account settings. Termination takes effect at the end of your current billing period for paid plans.

9.2 By Us

We reserve the right to suspend or terminate your access to the Service at any time if you violate these Terms, fail to pay fees when due, or if we decide to discontinue the Service. We will provide reasonable notice where practicable.

9.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections 5, 7, 8, and 10 survive termination.

10. Governing Law & Disputes

These Terms are governed by and construed in accordance with applicable law, without regard to its conflict-of-law provisions. Any disputes arising out of or in connection with these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or via the Service at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
